THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.40338 of 2017 ORDER:

The petitioner prays for the following relief: "....writ of mandamus declaring the action of respondent No.3 in permitting the 4th and 5th respondents in the schedule property situated in Sy.No.209 admeasuring Ac.2-50 cents forming part of Nandivargam Revenue Village, Banaganapalli Mandal, belongs to the 1st petitioner though the Hon'ble Court granted interim injunction order in I.a.No.907/2017 in O.S.No.160/2017 against the 4th and 5th respondents, as illegal, arbitrary......."

O.S.No.160 of 2017 is pending before the Court of Junior Civil Judge, Banaganapalli.

In I.A.No.907 of 2017 vide order dated 24.07.2017 interim orders are passed. It is, in this back ground, this Court is of the view that the writ prayer is unavailable. Writ Petition is dismissed by granting liberty to the petitioner to move the trial Court for ancillary and incidental reliefs, the petitioner thinks necessary. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed.
