No. 5034 of 2018 in Crime No.541 OF 2017 Dated 27.07.2017 under Sections 363,386 R/w 34 of IPC on the file of XVI Additional District and sessions judge, Ranga Reddy District, at Malkajgiri.
The petition coming on for hearing, upon perusing the Petltion and the grounds flled in support thereof and upon hearing the arguments of Sri GOVARDHAN REDDY JOUNDLA Advocate for the Petitioner, and of Additional Public Prosecutor(TG) for the respondent, the Court made the following.
ORDER
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner / A.3, f or grant of bail in Crime No.541 of 2Ot7 of Kushaiguda Police Station, Rachakonda District, registered for the offences punishable under Sections 363 and 386 read with 34 of IPC.
2, Heard the learned counsel for the petitioner/A.3, the learned Additional Public Prosecutor representing the respondent-State and perused the record, 3.
The name of the petitioner/A.3 was not found in the FIR, In the course of submissions, it is brought to the notice of this Court that the petitioner/A.4, whose name is found in the FIR was granted bail under Section 438 Cr.P.C. by this Court vide order dated 15.03.2018 in Crl.P.No.2977 of 2018 on some conditions, Under these circumstances, the petitioner/A,3 can also be granted bail on similar conditions, 4, Accordingly, the Criminal Petition is allowed. The petitioner/A.3 is directed to surrender before the Station House Officer, Kushaiguda Police Station, Rachakonda District, within a period of 15 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/A.3 on bail, on his executing a personal bond for a sum of Rs,20,O00,/- (Rupees twenty thousand only) with two sureties in a like sum each to his satisfaction. on such release. the
,) petitioner/A.3 shall abide by the conditions mentioned under Section 438(2) of Cr.P.C. as under:
t. The petitioner shall make himself available for interrogation by a police officer as and when required.
2. The petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
3. The petitioner shall not leave India without the previous permission of the Court.
Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
