Notice sent to the 2nd respondent returned unserved to the address furnished is taken as heard. Heard learned counsel for the petitioner and learned Public Prosecutor for the 1st respondent State. 2.

There are no grounds to extend the time upto October, 2019, when it is the duty to surrender the passport within the stipulated period of three (03) months from the order, dated 18.06.2018, having furnished the surety that can be forfeited otherwise and though the application for extension filed before that date of three months expires, once the Court below dismissed the application, there are no grounds to allow the petition, much less to extend the time, but for till end of February, 2019, to submit, else the trial Court can take recourse and he is also, by virtue of this order, for non-compliance, liable for contempt and trial Court can proceed against the sureties and recover the amount and forfeit the same to the State. 3.

With the above observations, the Criminal Petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence.
