HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.45337 of 2018 ORDER:

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for respondents 1 to 5.

A perusal of the averments in the affidavit filed in support of the writ petition goes to show that there are disputes between the petitioners and the unofficial respondents. Moreover, this Court cannot grant prayer sought for by the petitioners i.e., for declaring the sale deeds i.e., Sale Deed Nos.238/2013 in favour of respondents 7 to 9, 239/2013 dated 28.01.2013 by exercising jurisdiction under Article 226 of the Constitution of India, as the petitioner has effective alternate remedy before the competent court of law.

However, learned counsel for the petitioners submits that revision filed by the petitioners is pending before the Joint Collector and seeks a direction to be issued to the concerned Joint Collector to dispose of the same as expeditiously as possible. Since the revision filed by the petitioners is stated to be pending before the Joint Collector, without expressing any opinion on the merits of the case, the Joint Collector concerned is directed to dispose of the revision, after giving an opportunity of hearing to both sides, in accordance with law, within a period of four months from the date of receipt of a copy of this order.

With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. ___________________________ A.RAJASHEKER REDDY,J 20.12.2018 kvs
