THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.41595 of 2017 ORDER:
The counsel for petitioner submits that in spite of receiving the complaint, the respondent No.3 is not moving in the matter.
The Assistant Government Pleader (Home) on instructions submits that the complaint in fact has been received, General Diary entry was made. As a part of enquiry in terms of Lalita Kumari vs. Government of Uttar Pradesh1, the petitioner as well as the persons, against whom, the complaint has been made are summoned. Neither turned up.
The counsel for petitioner disputes that the petitioner was called.
Denial by counsel for petitioner is merely placed on record and the petitioner is under obligation to appear before the police to record the statement and thereafter, if there is no progress can complain inaction.
The Assistant Government Pleader (Home) submits that police would call the petitioner in next three (03) days. The statement is placed on record.
