The petitioner challenges the order of 3rdrespondent, who is the original authority, in proceedings No.C5/SR/54/2815/2016, dated 15-10-2016, wherein his licence was cancelled. Learned counsel for the petitioner says that the writ petition also to be allowed in terms of WP.No.14356 of 2017 and Batch, dated 11-10-2017.
Heard learned Advocate General for respondents. In view of the same, following the same, for the reasons alike, this writ petition is allowed in terms of WP.No.14356 of 2017 and Batch, dated 11-10-2017 by setting aside the impugned order of cancellation of licence. However, the authorities under the Seeds Act and the Seeds Control Order shall take appropriate steps for educating the farmers with regard to the future losses in case of spurious seeds. They shall also inspect the shops of the dealers periodically in order to prevent utilization of such spurious seeds by the farmers, resulting in huge loss to them. However, this order will not prevent the farmers from claiming compensation against the manufacturers and distributors, if any, in separate proceedings. As a sequel to the disposal of these petitions, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 08-12-2017 Nvl
