SMT JUSTICE T.RAJANI CRIMINAL PETITON No.12310 OF 2017 ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A2, in Crime No.47 of 2017 on the file of Boath Police Station, Adilabad District. The offences alleged are under Sections 417 and 420 of IPC. 2.
Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The public prosecutor brings to the notice of this Court that earlier this Court dismissed the anticipatory bail petition filed by the petitioner, considering the facts of the case and hence, this petition is not maintainable. The order of this Court in Crl.P.No.11300 of 2017, which is passed in petition filed for anticipatory bail for accused No.2, shows that the merits of the case were considered before dismissing the petition and it was categorically held that the petitioner would not entitled for bail under Section 438 Cr.P.C.. 4.
Hence, in view of the above circumstances, this court opines that this is not a fit case for granting anticipatory bail. 5.
Accordingly, the Criminal Petition is dismissed.
However, the petitioner can file a petition seeking for regular bail by surrendering himself before the court below. The
court below shall dispose of the bail application, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work.
As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed. _____________ T.RAJANI, J 23.01.2018 SS
