HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.45789 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 2nd respondent in issuing the proceedings dated 25.8.2018 for determining the quarry lease granted to the petitioner over an extent of 10,000 hectares situated in Sy.No.81, Kalvala Village, Shankarapatnam Mandal, Karimnagar District and the action of the 1st respondent in not disposing the appeal dated 6.9.2018, filed by the petitioner and proceeding to grant quarry lease to the third parties, as illegal and arbitrary.

Though the various grounds are raised, learned counsel for the petitioner, would contend that the though the appeal along with the stay petition was filed in the month of September, 2018, no orders are passed so far either in the stay petition or in the appeal. Learned Government Pleader for Mines and Geology, would submit that subsequent to filing of the appeal, the petitioner has filed additional grounds in appeal on 31.10.2018, for which remarks have been called for and if a reasonable time is given, the main appeal itself would be disposed of. But, the learned counsel for the petitioner would contend that atleast the stay application may be directed to be disposed of in accordance with law since there is every possibility of respondents granting lease in respect of the subject quarry in favour of the third parties.

Having regard to the above, the writ petition is disposed of directing the 1st respondent to dispose of the stay application filed along with the appeal dated 6.9.2018, in accordance with law, as early as possible preferably within a period of two weeks from today after giving reasonable opportunity of hearing to the petitioner and all concerned and thereafter dispose of the main appeal at the earliest. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
