SMT JUSTICE T.RAJANI CRIMINAL PETITON No.12744 OF 2017 ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A3, in C.O.R.No.23 of 2017 on the file of Prohibition and Excise Police Station, Morthad, Nizamabad District. The offences alleged are under Sections 8(c) r/w 22 of NDPS Act, 1985 and 34(A) r/w 34(1) of A.P.Excise Act, 1968 r/w 4(A), 5(A) of A.P.Excise Rules, 1973. 2.
Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

It is observed that this Court, vide order dated 23.08.2017 in Crl.P.No.5777 of 2017, dismissed the earlier anticipatory bail application by considering that the Alprazolam alleged to have seized is a commercial quantity.

Hence, in view of the above, this court opines that this is not a fit case for granting anticipatory bail.

Accordingly, the Criminal Petition is dismissed. However, the petitioner can file a petition seeking for regular bail by surrendering himself before the court below. The court below shall dispose of the bail application, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work.
As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed.
