HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.45330 of 2018 ORDER:
1) Heard learned counsel for the petitioners and learned Standing Counsel for GHMC.
2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of respondents Nos. 2 to 4 in taking action against the illegal construction of respondent No. 5 being done on the southern side of properties bearing M.C. Nos.20-7-628/ 1 and 20-7628/ 2, Fateh Darwaza, Hyderabad on the basis of complaint dated 01.12.2018, as highly illegal arbitrary and in violation of the provisions of the GHMC Act.
3) Though various grounds are raised, learned counsel for the petitioners would submit that on 01.12.2018, the petitioner made a written representation to the Deputy Commissioner, copy marked to the Commissioner of GHMC, Chief Town Planning Officer and the Assistant City Planner against the illegal constructions being raised by respondent No.5, though the entire land abutting to the land of the petitioner was acquired by GHMC.
4) Learned Standing Counsel on instructions states that petitioners have made a representation on 01.12.2018, bringing to the notice of the authorities the alleged acts and that the authorities would take action, in accordance with law.
5) Having regard to the above, the Writ Petition is disposed of directing the authorities - Deputy Commissioner, GHMC, to take appropriate action
in the complaint made by the petitioner bringing to his notice the acts of respondent No.5 referred to above, in accordance with law, after giving notice to the petitioner and the unofficial respondent and then deal with the same, as early as possible, preferably within a period of six to eight weeks from the date of receipt of the order. No costs. 6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
