THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.45515 OF 2018 ORDER:

When the matter is taken up for hearing, learned counsel for the petitioner as well as learned counsel for the respondents expressed that they are willing to settle the issue in respect of the claim amount of the deceased person amicably and the 4th respondent is willing to part 1/3rd of the claim amount in favour of the petitioner as the petitioner is mother of the deceased person.

Learned counsel appearing for unofficial respondent had contended that in view of the entitlement of the petitioner and the 4th respondent, the amount should be disbursed accordingly.

This Court, having considered the rival submissions of both the parties, is of the considered view that the amount claimed by the petitioner to the extent of 1/3rd shall be settled in favour of the petitioner and the balance amount shall be settled in favour of the 4th respondent.

With the above direction, this writ petition is disposed of. There shall be no order as to costs.

Interlocutory applications pending, if any, shall stand closed. No order as to costs.
