THE HON'BLE SRI JUSTICE S.V.BHATT CIVIL REVISION PETITION No.7426 of 2018 ORDER:

Heard Sri Sai Gangadhar Chamarty, learned counsel for petitioner and Sri N.Srihari, learned counsel for respondent. Mr.Sai Gangadhar Chamarty requests one year time to vacate and deliver the vacant possession to respondent, the petition schedule property.

Mr.N.Srihari submits that the revision petitioner is not entitled for any indulgence from this Court inasmuch as the revision petitioner has not been paying the rent from January, 2013.

Counsel for the petitioner is unable to immediately explain the stand of revision petitioner/tenant.

Having regard to non-payment of rent and continue to enjoy the property; keeping in view the request made by the learned counsel for petitioner, the revision petitioner is granted four months time from today subject to following conditions. (a) The revision petitioner, on or before 24.01.2019 files undertaking to vacate the premises within the time granted by this Court before the High Court of Judicature, Amaravathi and also that the revision petitioner will clear the entire arrears within six weeks from today.

(b) 50% of the arrears payable shall be paid along with the undertaking directed to be filed in this behalf.

(c) Failure to file undertaking or depositing rent or filing proof of payment of rent, the time granted by this Court shall be deemed to be vacated without reference to further orders in this behalf.

With the above observations, the Civil Revision Petition is disposed of. No order as to costs.
