HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.45382 of 2018 ORDER:

This writ petition is filed seeking a direction to respondents 1 to 4 not to interfere with the possession and enjoyment of petitioner over land admeasuring Ac.5-65 cents in Sy.No.2580 of S.Upparapalli Village, Railway Kodur Mandal, Y.S.R.Kadapa District.

Learned Assistant Government Pleader for Revenue basing on instructions submits that suits filed by the petitioner and unofficial respondents were dismissed. Learned counsel for the petitioner submits that since there is a finding that the subject property is the Government land, the respondents are trying to change the name of unofficial respondents. He also submits that first appeals are filed against the said judgment. Learned Assistant Government Pleader produced the written instructions to the same effect.

In view of the same, it is open for the petitioner to obtain appropriate orders in the appeals filed in the appellate Court. Instead of obtaining the same, the petitioner filed the present writ petition.

Since the petitioner has an effective alternative remedy and already filed the appeal, the writ petition is disposed of granting liberty to the petitioner to obtain appropriate orders in the appeals filed against suits.

There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
