HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.42106 of 2017 ORDER:

The grievance of the writ petitioner is with regard to the action of the respondent authorities in not releasing the vehicle bearing registration no.OR 18 B 7281 despite submission of a petition, on 17.10.2017, to the 3rd respondent for release of the said vehicle.

At the hearing, learned counsel for the petitioner requests for release of the vehicle with appropriate terms and conditions, inter alia, stating that on transfer of the 3rd respondent no officer is posted in his place and, therefore, his application for release of the vehicle is not being disposed of. Learned Government Pleader representing the respondents would submit that there would be incharge arrangements and, therefore, a direction may be given to the 3rd respondent or the officer holding full additional charge of his post to consider and dispose of the application of the petitioner within a time frame. Recording the afore-stated submissions, the Writ Petition is disposed of directing the 3rd respondent or the officer holding full additional charge of the post of the 3rd respondent to consider and dispose of the petition, dated 17.

10.2017, submitted by the petitioner for release of the vehicle as expeditiously as possible and preferably within three (03) days from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
