THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.40360 of 2017 ORDER:

The petitioner prays for the following relief: ".......writ of mandamus declaring the action of the 7th respondent in changing the complaint and registering the Crime on the eye witnesses instead of registering the crime against the prime accused is illegal, arbitrary, unlawful and against principle of natural justice and violative of Articles 14 and 21 of the Constitution of India......"

The Assistant Government Pleader (Home) submits that Crime No.217 of 2017 was registered on petitioner on 18.11.2017. He further submits that as crime alone is registered, respondent No.7 will follow the procedure stipulated under Section 41-A of Criminal Procedure Code. The statement is placed on record.

Writ petition is disposed of, accordingly. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
