The petitioner states that she is a resident of Manthati Village and belongs to Washermen community, which comes under BC-A category. She states that she passed SSC examination and fully eligible and qualified to hold the post of Village Revenue Assistant. The second respondent issued a notification on 27.12.2013 inviting applications to the post of Village Revenue Assistant and as per the said notification, the eligible candidate should be a native of the revenue village for which the recruitment is notified. Manthati Village of Nagarkurnool Mandal and District was also notified as one of the revenue villages, where the Village Revenue Assistant would be appointed. It appears that along with the petitioner, respondent Nos.5 and 6 also applied for the said post.
Since 2013 no further action was taken, except including the names of the petitioner and respondent Nos.5 and 6 in the list of candidates applied for the post. The petitioner states that she submitted a representation to the District Collector on 16.11.2015 with regard to the disqualification of respondent Nos.5 and 6 and in spite of the same, when no action was taken, the present Writ Petition is filed.
As per the averments in the present Writ Petition, as on today, no action for appointment of any candidate was taken up by the appointing authority.
In the circumstances, since a representation was already filed by the petitioner before the appointing authority, it is for the appointing authority to take the facts and the qualifications required for the post of Village Revenue Assistant into consideration and take necessary action.
This Court is of the opinion that the Writ Petition is premature at this stage, and the Writ Petition is, accordingly, dismissed. If the petitioner is aggrieved after issuance of orders of appointment, it is open to the petitioner to challenge the appointment of any person who is not qualified. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 28.11.2017 vs
