Heard learned counsel for petitioner and the learned Standing Counsel for Greater Visakhapatnam Municipal Corporation.

With the consent of both the counsel, the writ petition is disposed of at the stage of admission.

The present writ petition came to be filed seeking issuance of writ of Mandamus declaring the action of the 2nd respondent in threatening to remove tower installed on the terrace of building bearing D.No.31-10-16, T.S.No.1438, Allipuram Ward, Visakhapatnam, Andhra Pradesh, without issuing any notice, as illegal and arbitrary.

Learned counsel for the petitioner submitted that the 2nd respondent is interfering with the possession of cell tower installed on the terrace of building bearing D.No.31-10-16, T.S.No.1438, Allipuram Ward, Visakhapatnam, Andhra Pradesh, without following due process of law.

Sri S.Lakshminarayana Reddy, learned Standing Counsel appearing for respondents submits that any action that will be taken by the respondents would be in accordance with law.

Having regard to the above, the writ petition is disposed of directing that the respondent authorities if intend to take any action, insofar as cell tower said to have been installed by the petitioner, the same shall be in accordance with law. No order as to costs.

Miscellaneous petitions, if any pending, in this appeal shall stand closed.
