It is the case of the petitioner that he filed appeal before the 2nd respondent against grant of mutation in favour of 4th respondent in respect of subject land admeasuring Ac.7-13 cents out of Ac.08-13 cents in R.S.No.266/4 and the same is pending before the 2nd respondent. As the same is not being disposed of, the present writ petition is filed.
Learned Assistant Government Pleader for Revenue submits that the petitioner filed the appeal under wrong provision of law. Instead of Section 5(5) of A.P.Rights in land and Pattadar Passbooks Act, (for short "the Act") Section 5-B of the Act is mentioned by him. The petitioner could have filed appeal under Section 5 (5) of the Act.
Learned counsel for the petitioner says that the same will be rectified by the petitioner.
In view of the same, without expressing any opinion on merits, the writ petition is disposed of directing the 2nd respondent to dispose of the appeal filed by the petitioner in accordance with law.
Interlocutory applications pending, if any, shall stand closed. No costs.
