HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.45409 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the respondents 2 to 4, in not considering the representation of the petitioner dated 22.11.2018, wherein the petitioner requested the respondent-authorities, to take appropriate legal action to stop the illegal constructions being carried out by the respondents 5 to 14 over the premises bearing Nos.21-1-473, 21-1-474 and 21-1-573, Rikab Gunj, Hyderabad, without obtaining valid construction permission from the competent authority, as illegal and arbitrary. Though various grounds are raised, the learned counsel for the petitioner, would submit that though the petitioner submitted a representation to the respondents 2 to 4 on 22.11.2018, seeking to take action against the illegal constructions made by the respondents 5 to 14 over the subject premises, no action has been taken so far. The learned Standing Counsel for the 2nd respondent, would submit that the respondent-authorities, may be directed to pass appropriate orders on the representation of the petitioner, in accordance with law, at the earliest.
Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the respondents 2 to 4, to deal with the representation dated 22.11.2018, submitted by the petitioner seeking to take action against the illegal constructions made by the respondents 5 to 14, over the subject premises, and pass appropriate orders, in accordance with law as early as possible, preferably within a period of six to eight weeks from the date of receipt of copy of this order by giving reasonable opportunity of hearing to the petitioner and all concerned. No order as to costs.
As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
