THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.NO.42414 OF 2017 ORAL ORDER (Per the Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, petitioners have challenged order dated 12.10.2017 passed by the Andhra Pradesh Administrative Tribunal at Hyderabad in O.A.No.2369 of 2017, whereby the learned Tribunal has given liberty to the petitioners to file fresh representation to the 4th respondent - Superintendent of Police, Srikakulam, Srikakulam District on the subject for considering the issue of their promotion in the light of G.O.Ms.No.95. The Tribunal further directed that pending representations, if any, shall be disposed of within two months from the date of receipt of a copy of the order.
The learned counsel appearing on behalf of the petitioners submit that the petitioners have filed representation and the same was received by the 4th respondent on 5.12.2017, however, till date no decision has been taken by the said respondent.
Keeping in view the direction passed by the Tribunal and the representation made by the petitioners, we are of the opinion that there are two options left open to the petitioners, viz., (i) either to file contempt petition before the Tribunal, or (ii) to wait for the decision of the 4th respondent.
At this stage, the learned counsel for the petitioners, seek permission to withdraw the instant petition with liberty to take steps under law before appropriate forum.
Accordingly permission is granted and the writ petition is dismissed as withdrawn with liberty as prayed for.
