This writ petition is filed to declare the action of respondents 2 to 5 in not considering the petitioner's application submitted in Form-5 for grant of commission agent licence, inspite of receiving licence fee as well as penalty as illegal and arbitrary. Learned counsel for the petitioner submits that the lis in the writ petition is covered by order in WP.No.39682 of 2017, dated 23-11-2017. The same is not disputed by Sri Ch.Srinivas, learned Standing Counsel for respondents 4 and 5. In view of the same, for the reasons alike, this writ petition is also allowed directing the 4th respondent to consider the petitioner's application for grant of commission agent's licence and pass appropriate orders without reference to G.O.Ms.No.57, Agriculture and Cooperation (AM-II) Department, dated 12-10-2015, but, by applying the norms in G.O.Ms.No.
190, Agriculture and Cooperation (MKTG.I) Department, dated 06-04-1994, and communicate the decision to the petitioner within two weeks from the date of receipt of a copy of this order. No order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.
