HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 42530 of 2017 Order:
The petitioner joined the service of the respondent Corporation as a Driver in September 2011. While he was operating the bus with TIM Machine on route Hyderabad to Korutla on 24.11.2017, the bus was checked at stage No.8/7 and certain irregularities were noticed. On the basis of the report of the checking officials, the petitioner was issued a charge memo on 24.11.2017. He was placed under suspension on 07.12.2017 and a charge sheet was also issued on the same day. The petitioner submitted his explanation to the charge memo on 28.11.2017 and also submitted separate explanation to the charge sheet on 12.12.2017. However, the present Writ Petition is filed challenging the order of suspension dated 07.12.2017.
This Court carefully perused the impugned order of suspension and the said order of suspension is based on cash and ticket irregularities and hence this Court is not inclined to entertain the present Writ Petition. However, since the petitioner already submitted his explanation to the charge sheet, the enquiry against the petitioner shall be concluded as expeditiously as possible, but not later than two (2) months from the date of receipt of a copy of this order. It is needless to observe that the petitioner shall cooperate for conclusion of the enquiry. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
