HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.40969 OF 2017 ORDER:
The case of the petitioner is that he made representation on 28-11-2017 for grant of two installments for payment of 50% of October, 2017 current consumption charges on 5th January, 2018 and remaining 50% on 05th February, 2018 and the same is not considered in terms of Regulation 5 of 2004, provisions of Electricity Act, 2003 and Clause 8.2.3 of the General Terms and Conditions of Supply. Aggrieved by the same, the present writ petition is filed. Learned counsel for the petitioner submits that due to fire accident occurred in petitioner's company, financial position of the petitioner-company is badly affected and the petitioner is not in a position to pay bill of Rs.80,21,832/- towards current consumption charges for the month of October, 2017 at one stretch and in similar circumstances this Court disposed of writ petition No.36641 of 2017 and that the petitioner will pay current consumption charges in two installments.
In view of the above facts and circumstances, the respondents are directed to permit the petitioner for payment of 50% of October, 2017 current consumption charges on 5th January, 2018 and remaining 50% on 05th February, 2018. Till such time, the respondents shall not disconnect power supply to the service connection of the petitioner. Grant of
installments by this Court is subject to payment of interest by the petitioner as per Tariff order. In the event of failure to pay the installments as indicated above within the stipulated time, the respondents are at liberty to take action including disconnection of power supply as envisaged under Section 56 of the Electricity Act.
With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 05-12-2017 Note:
