CVNR,J & GSP,J W.P.No.40675 of 2017 18.01.2018 ORDER: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed for issue of Habeas Corpus directing the respondents to produce the son of the petitioner viz., Kasula Umesh Goud (for short 'the alleged detenu') before this Court and set him at liberty.

In the counter-affidavit filed by respondent No.4, it is, inter alia, stated that the alleged detenu is accused in Crime No.671 of 2015 registered for the offences punishable under Sections 420, 406 and 506 I.P.C. on the file of Chaitanyapuri Police Station and that in connection with the said crime, the investigating officer issued notice under Section 41(A) Cr.P.C. on 24.11.2017 and after serving the said notice on the alleged detenu, he was let off with a direction to appear before the Police and the jurisdictional Court as and when required. In the light of the aforementioned averments in the counter-affidavit, the learned counsel for the petitioner has requested for closure of the writ petition as adjudication on merits is not necessary.
