HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.41656 of 2017 ORDER:
The grievance of the writ petitioner is that the 4th respondent is proceeding with illegal and unauthorized constructions in an area of 60 Square Yards and that he is constructing G + 3 floors without leaving any set backs all around such constructions and that despite a representation, dated 23.11.2017, against such illegal and unauthorized constructions being made by the 4th respondent, respondents 2 & 3 have not taken any action.
At the hearing, learned counsel for the petitioner submits that if the respondents 2 & 3 are directed to consider and dispose of the afore-said representation of the petitioner in accordance with law, the ends of justice would be met.
Learned standing counsel representing the respondents 2 & 3 endorses the said submission.
Recording the afore-stated submissions, the Writ Petition is disposed of directing the respondents 2 & 3 to consider and dispose of the representation, dated 23.11.2017, of the petitioner, within a period of four (04) weeks from the date of receipt of a copy of this order, however, in strict accordance with the procedure established by law, and communicate the decision taken thereon to the petitioner within a week thereafter.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
