THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY WRIT PETITION No.39686 of 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking writ of Mandamus declaring the action of the respondents in laying a road across the house site of the petitioner admeasuring 150 square yards situated in Survey No.571/A of Ursu Village near to the Santoshimatha Temple abutting to Hunter road leading from Hanamkonda to Warangal without following the procedure prescribed under the Land Acquisition Act and without paying compensation to the petitioner, as illegal, arbitrary violative of Article 300-A of the Constitution of India and consequently, direct the respondents not to lay the road across the petitioner's house site without following due process of law.

Smt. Pingali Lakshmi, the learned Standing Counsel for Warangal Municipal Corporation, and Sri M.Ajay Kumar, the learned Standing Counsel for Kakatiya Urban Development Authority, submitted that road will not be laid without following due process of law.

In view of the submission made by learned Standing Counsels for respondent Nos.2 and 3, respondent Nos.2 and 3 are hereby directed not to take house site of the petitioner situated in Survey No.571/A of Ursu Village near to the Santoshimatha Temple abutting to Hunter road leading from Hanamkonda to Warangal without following due process of law.
