HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION Nos.45414 and 45426 of 2018 COMMON ORDER:
In both the Writ Petitions, petitioners contend that, while proceedings were initiated against them in terms of Section 6-A of the Essential Commodities Act, as on date neither there is suspension nor cancellation of the authorization granted in their favour under Telangana State Public Distribution System (Control) Order, 2016. As it is settled in a catena of judgments that, as long as the authorization granted in favour of the dealer subsists, the dealer would be entitled to carry on business and distribute essential commodities. As on date, there being no cancellation or suspension of the authorization, petitioners would be entitled for supply of essential commodities.
The Writ Petitions are, accordingly, allowed with a direction to the respondents to supply essential commodities to the petitioners for distributing the same to the public. However, this order shall not preclude the respondents from taking action for the alleged violation of the petitioners.
