Petition filed under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the Grounds of Criminal Petition, the High Court may be pleased to release the Petitioners/Accused Nos. 1 & 2 on bail pending investigation, inquiry and trial in Crime No. 103 of 2017 of Chittoor I Town Police Station, Chittoor District.

The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri D. Purna Chandra Reddy, Advocate for the Petitioners and of Addl. Public Prosecutor(AP) on behalf of Respondent-State, the Court made the following ORDER :- "Heard learned counsel for the petitioners/A.1 and A.2, learned Additional Public Prosecutor for the respondent State and perused the record. This petition is filed under Section 439 Cr.P.C. for grant of bail to the petitioners/A.1 and A.2 in Crime No.103 of 2017 of Chittoor I Town Police Station, Chittoor District, for the offences punishable under Section 20(B)(i) of NDPS Act, 1985 and Section 273 IPC read with Section 34 IPC. Learned counsel for the petitioners/A.1 and A.2 would submit that 1 kg of ganja along with gutkha alleged to have been seized from the possession of petitioner/A.1. The offence alleged under Section 273 IPC is triable by the Court of Magistrate.

In view of the quantity of contraband seized and the nature of allegations, the petitioners/A.1 and A.2 are ordered to be released on bail, each of them executing a personal bond for Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the learned IV Additional Judicial Magistrate of First Class, Chittoor. On such release, the petitioners/A.1 and A.2 shall attend before the Station House Officer concerned on every Sunday between 09.00 and 10.00 a.m. till filing charge sheet.
