When the matter is called, Sri A. Jagan, learned counsel for the petitioner, seeks permission of this Court to withdraw the instant petition with liberty to file a petition under Section 70(2) Cr.P.C. to recall the warrant, in view of completion of entire trial before the trial Court.

Permission is accorded.

Accordingly, this Criminal Petition is dismissed as withdrawn. However, liberty is given to the petitioner to file a petition under Section 70(2) Cr.P.C. to recall the warrant, in view of completion of entire trial in the Court. On filing such application, after serving notice on the counsel for the respondent, the Magistrate is directed to dispose of the petition on the same day in accordance with law. As a sequel, miscellaneous applications pending, if any, shall stand closed.
