HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.45427 of 2018 ORDER:
1) Heard learned counsel for the petitioner and learned Standing Counsel for Municipal Corporation.
2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not paying the amounts for the work completed by the petitioner i.e., laying of CC Road from H.No.31-2-106 to end of the road and 31-2-111 at Madhu Thanda Komatipally in W.No.54, Hanamkonda GWMC, in pursuance of agreement No.Roc.No.E3/15811/2016, dated 08-05-2017, as arbitrary and illegal.
3) Learned Standing Counsel, on instructions, states that there is a delay in execution and in view of the delay, there would be certain deductions in the form of penalty to be paid and after completing the work, the amount that is due will be paid at the earliest. Learned counsel for the petitioner disputes the same.
4) Having regard to the facts and circumstances and in view of the submissions made, the writ petition is disposed of directing the second respondent, to pay the amount which the petitioner is entitled to, within a period of four to six weeks from the date of receipt of the order.
