HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.45432 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the 2nd respondent in trying to demolish the shop of the petitioner situated at D.No.25-8-256, Kurupam Market, Main Road, Visakhapatnam, without following the due process of law, as illegal and arbitrary.
Though various grounds are raised, the learned counsel for the petitioner, would submit that a direction may be given to the 2nd respondent not to demolish the subject premises of the petitioner without following the procedure established under law. The learned Standing Counsel for the 2nd respondent, would submit that the notices have already been issued to the landlord and that similar notice will be issued to the tenant and thereafter any action to be taken will be taken only in accordance with the procedure established under.
In view of the statement made by the learned Standing Counsel for the 2nd respondent, the writ petition is disposed of directing the respondent-authorities, not to take any coercive steps of demolition or removal of any portion of the subject premises, except following the procedure established under law. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
