HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.45448 of 2018 ORDER:

This writ petition is filed aggrieved by action of respondents 3 and 4 in trying to dispossess the petitioner from the land admeasuring Ac.0-40 cents in Sy.No.2207-10 of Venkateswarapuram Village, Nellore Urban Mandal, SPSR Nellore District without following due procedure. Learned Assistant Government Pleader for Revenue produced written instructions stating that the Government has resumed the CJFS land an extent of Ac.61.22 cents adjacent to the petitioner's land in Sy.No.2207-10 of Venkateswarapuram Village.

The land to an extent of Ac.0-40 cents in Sy.No.2207/10 belongs to the petitioner is not resumed by the Government and hence, the question of dispossession does not arise. It is only an apprehension of the petitioner. Hence, respondents 3 and 4 are not trying to dispossess the petitioner. Recording the same, the writ petition is disposed of directing the respondents not to evict the petitioner without following procedure of law. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
