THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.43519 OF 2017 ORDER:

This writ petition is filed challenging the action of the respondents in not considering the representation dated 15.12.2017 submitted by the petitioners for engagement on contract basis while considering various other similarly situated persons for appointment in Artisan Grade.

It is stated in the affidavit filed in support of the writ petition that a circular was issued by the fourth respondent on 15.02.2017 to all the Superintending Engineers to obtain the information with regard to outsourcing persons working under their control and furnish the same to his office on or before 25.02.2017. The said communication was not known to the public. It is also the case of the petitioners that certain guidelines were issued to absorb the outsourcing persons in compliance with the orders dated 01.06.2017. The petitioners also state that when the scheme of regularisation was challenged in WP (PIL) No.149 of 2017 the same was suspended.

However, the Division Bench of this Court appears to have permitted the payment of salaries directly to the employees engaged by the respondents who were earlier absorbed by removing the contractor. Admittedly, the petitioners are not working in the respondent Corporation and they cannot seek any absorption. It is for the respondents to engage the services of the petitioners, if they want to engage them. This Court cannot grant any direction.

However, the writ petition is disposed of by directing the respondents to take into consideration the representation of the petitioners dated 15.12.2017, as and when they choose to appoint the persons on contract basis. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed. There shall be no order as to costs. __________________________ A.RAMALINGESWARA RAO, J 20.12.2017 pln
