This Criminal Revision Case under Section 397 and 401 of the Code of Criminal Procedure, 1973, is arising out of the docket order dated 10.12.2018 passed in Crl.M.P.No.495 of 2018 in Crl.M.P.No.574 of 2018 in Crl.A.No.1016 of 2018 passed by the V-Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar, Hyderabad.

Aggrieved by the impugned docket order, petitioner has preferred this revision contending that while suspending the sentence, the trial Court directed the petitioner to deposit 5% of the cheque amount within two weeks and petitioner has to deposit a sum of Rs.70,000/-.

Learned counsel for the petitioner submits that petitioner has been suffering with ill-health and incurring huge amount of expenditure for his treatment and medicines. As such, he could not secure the amount to deposit before the trial Court and therefore, sought for extension of four more weeks. The trial Court has partly allowed the said petition granting time till 21.12.2018. Even by that time petitioner could not pay the amount and preferred this revision for relaxation of condition imposed by the trial Court.

Learned counsel for the petitioner states that petitioner has been suffering with ill-health and as he incurred huge amount for his treatment, he could not pay the 5% amount.

In view of the fact that petitioner is virtually seeking for relaxation of condition for extension of time, it is appropriate to grant time till 31.01.2019 for depositing 5% of the cheque amount before the trial Court.
