HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.39873 of 2017 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue (Telangana) appearing for the respondents.

Petitioner's grievance is that he had made an application to respondent No.3 for issuance of Occupancy Rights Certificate (for short 'ORC') under Section-4 of the A.P. (Telangana Area) Abolition of Inams Act, 1955 for the subject land which has been numbered as file No.L/7171/2012 and that respondent No.3 is not disposing of the same.

Learned Government Pleader for Revenue (Telangana) appearing for respondents states that earlier ORC for the subject land was issued to a third party, but it was set aside in appeal; that challenging the same, the said person had filed Writ Petition No.25704 of 2011 before this Court; and that there are no interim orders passed in the said Writ Petition.

It is not as if there is any stay of further enquiry into the issuance of ORC for the subject land granted by this Court in the said Writ Petition. Therefore, there is no impediment for respondent No.3

to consider the petitioner's application for issuance of ORC for the subject land.

Accordingly, the Writ Petition is disposed of directing respondent No.3 to decide the ORC application, vide file No.L/7171/2012, made by the petitioner within two months from the date of receipt of a copy of this order after giving notice to the affected party. However, any decision of respondent No.3 on the said ORC application of the petitioner will be subject to the final orders that may be passed by this Court in Writ Petition No.25704 of 2011. As a sequel, Miscellaneous Petitions, if any, pending, shall stand dismissed as infructuous.
