This Criminal Petition, under Section 438 of Cr.P.C., is filed by the petitioner/accused, seeking anticipatory bail in the event of his arrest in connection with F.I.R. No.94 of 2017, on the file of Chejerla Police Station, Sri S.P.S.R. Nellore District, registered for the offence under Section 307 of I.P.C.
Heard the learned counsel for the petitioner/accused, learned Additional Public Prosecutor appearing for the respondent-State, and perused the record.
Learned counsel for the petitioner would submit that the ingredients of Section 307 I.P.C. have no application to the facts of the case on hand. The petitioner is an innocent person and is falsely implicated in this case and ultimately prayed to allow the Petition.
Learned Additional Public Prosecutor, appearing for the respondent-State, opposed grant of bail to the petitioner. The material on record reveals that on 09.10.2017 afternoon when the de-facto complainant was at bus-stand centre in Madapali village, the petitioner/accused, who is the son of his brother, questioning why he abused his father and caused bleeding injuries with a knife on his right wrist, knee, right palm and below his chin.
There are specific overt acts made against the petitioner/accused; the matter requires investigation. Hence, it is it is not a fit case to enlarge the petitioner/accused on bail under Section 438 Cr.P.C.
Hence, the Criminal Petition is dismissed.
