This writ petition is filed challenging the action of the respondents 4 and 5 in trying to demolish the petitioner's Seri-culture shed and in trying to dispossess the petitioner from the agricultural land with standing crop "Seri Culture Malbar Trees" to an extent of Ac.5.50 cents in Sy.No.140/2, situated at Hussainpuram Grampanchayat, Perugupalli Village, Veligangla Mandal, Prakasam District. Learned Assistant Government Pleader for Irrigation submits that Survey No.l40/2 contains Ac.9.56 cents; that petitioner's claim can be restricted only to Ac.3.50 cents as she produced registered sale deed vide Document No.949/1999 to an extent of land Ac.3.50 cents. As far as remaining extent of 2.00 Acres of land claimed by the petitioner is concerned, no document is filed in respect of the same.
In view of the same, though petitioner is claiming relief to an extent of Ac.5.50 cents, as she produced documents showing that she is possession of the land only to an extent of Ac.3.50 cents, there shall be direction to the respondents not to dispossess the petitioner from the land to an extent of Ac.3.50 cents in Sy.No.140/2 without following due process
of law. If petitioner tries to encroach any other land, it is open for the respondent authorities to stop the same. Accordingly, the writ petition is disposed of. No order as to costs.
As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 15.12.2018 tk
