THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.43106 of 2017 ORDER:
The petitioner complains against inaction of respondents in looking at the complaint dated 08.12.2017, as illegal and contrary to Criminal Procedure Code.
The Assistant Government Pleader (Home) on instructions submits that the respondents are not disputing the receipt of complaint dated 08.12.2017. According to her, an entry is made in the General Diary and the respondents by following the principles laid down by Hon'ble Supreme Court in Lalitha Kumari vs. State of Uttar Pradesh1, would firstly enquire into and if the circumstances further warrant, register a crime, then investigate in the matter.
The statement is placed on record.
Writ petition is accordingly, disposed of. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
