HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.45548 of 2018 ORDER:

This writ petition is filed challenging the action of the respondents in not issuing pattadar pass book and title deed to the petitioner in respect of the land to an extent of Ac.1.54 cents in Sy.No.712/1 of Valasapalle Village, Madanapalli Mandal and in not mutating the name of the petitioner in respect of the said land.

The case of the petitioner is that originally Ac.5.15 cents of land is assigned to an ex-serviceman i.e. Pasala Venkata Ramana vide DKT Patta No.1738/4/66 on 04.05.1957; that after the said assignment the said lands were reclaimed and brought under cultivation and revenue records are also mutated in his name. While so, the said assignee gifted this land to his two wives through registered gift deed and after the said gift settlement the donees are in possession and enjoyment of these lands and even their names were mutated in revenue records. Subsequently, the donees and their children sold away this property to Sunkara Ramachandra through registered sale deed on 08.02.2006 and after the said purchase, the purchaser's name is mutated in the revenue records and pattadar pass book and title deeds were issued for the said extent of land. The revenue authorities even recognized the said Sunkara Ramachandra's title and

possession, by obtaining the consent from the said person while forming the road in the said land. The revenue authorities paid the compensation to the said person for Ac.1.93 cents of land acquired for Handri-Neeva Sujala Sravanthi Project. Subsequently, for the remaining land i.e. Ac.3.08 cents the said Sunkara Ramachandra executed a registered General Power of Attorney in favour of Avuku Anki Reddy and T.Raja Reddy on 28.06.2008. The said GPA holders executed two registered sale deeds, one in favour of the petitioner for Ac.1.54 cents and another in favour of A.Raj Kumar Reddy for similar extent on 23.09.2015. Since the date of purchase, the petitioner is in possession of her extent i.e. Ac.1.54 cents in Sy.No.

712/1 of Valasapalli Village and also applied for mutation of her name in revenue records and for issuance of pattadar pass book and title deed by duly paying the requisite fee on 10.10.2015. When the said application was not considered, the petitioner made representation on 17.06.2017 by way of reminder but invain. Aggrieved by the inaction of the respondents in not considering her representation, present writ petition is filed. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

In view of the aforesaid facts and circumstances, the competent authority is directed to consider the application of the petitioner dated 10.10.2015 and also the subsequent

representation 17.06.2017 and take action, in accordance with law, within a period of two months from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs.
