HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.45494 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents 1 to 3 in not passing any orders on the representation dated 23.10.2018, submitted by the petitioners requesting to take action against the respondents 4 to 6, for making unauthorized construction in the Government land, which is earmarked for public road, situated at Ganjella Road, 18th Ward of Yemmiganur Town, Kurnool District, as illegal and arbitrary.

Though various grounds are raised, the learned counsel for the petitioners, would submit that though the petitioner submitted a representation to the respondents 1 to 3 on 23.10.2018, seeking to take action against the illegal constructions made by the respondents 4 to 6 over the subject land, no action has been taken so far. The learned Standing Counsel for the 2nd respondent, would submit that the representation dated 23.10.2018, said to have been made, was not received in the office of the 2nd respondent and if a fresh representation is made by the petitioners, the respondent-authorities, would deal with the same in accordance with law.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the petitioners to submit a fresh representation by putting forth their grievance about the alleged encroachments and un-authorised constructions said to have been made in the subject land within a period of one week from today, in which event, the respondent-authorities, shall deal with the same and pass appropriate orders, in accordance with law as early as possible, preferably within a period of three to four weeks from the date of receipt of copy of this order by giving reasonable opportunity of hearing to the petitioner and all concerned. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
