The present writ petition came to be filed seeking to declare the action of the respondents 2 and 3 in marking the premises of the petitioner situated at D.No.24-7-149, Plot No.281, 4th Cross Central Avenue, SRK School Back side road, Magunta Layout, Dargamitta, S.P.S.R Nellore District, as illegal and arbitrary. Though various grounds are raised, the learned counsel for the petitioner, would submit that a direction may be given to the respondents 2 and 3 not to demolish the subject premises of the petitioner without following due process of law. The learned Standing Counsel for the respondents 2 and 3, would submit that even according to the petitioner only markings alleged to have been made and that any further steps for demolition or removal of the subject premises of the petitioner only will be made in accordance with the procedure establihsed under law.
In view of the statement made by the learned Standing Counsel for the respondents 2 and 2, the writ petition is disposed of directing the respondents 2 and 3 herein not to take any coercive steps of demolition or removal of any portion of the subject premises, except following the procedure established under law. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
