UMA DEVI WRI T PETI TI ON No.42395 of 2017 ORDER: (per Justice Sanjay Kumar) The prayer of the petitioner in this writ petition reads as under: "For the reasons stated above, it is just and necessary that this Hon'ble Court may be pleased to issue any writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents in conducting e-Auction and attempting to dispossess the petitioner from her property in issued e-Auction Sale notice dated 6-11-2017 and e-Auction dated 11-12-2017 to residential site of Ac.2-00 cents or 80 guntas of land in R.S.No.

121 part, situated at Village and Gram Panchayat Bogaram, Keesara Mandal, Ranga Reddy District and to take possession at any cost and at any time by brining further men as illegal, arbitrary, and violative of principles of natural justice and consequently to direct the respondents to set aside e-Auction Sale Notice dated 06-11-2017 and stop conducting e-Auction and not to dispossess the petitioner from her residential property without following due process of law and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Sri C.Prabhakar, learned counsel on caveat for the IDBI Bank Limited, would however inform this Court that for want of bidders, the auction sale scheduled to be held on 11.12.2017 failed. In that view of the matter, challenge to the e-auction sale notice dated 06.11.2017, whereunder the auction was proposed to be held on 11.12.2017, has become purely academic and does not warrant consideration on merits.

The writ petition is accordingly dismissed on this short ground leaving all issues open.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
