HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 39775 of 2017 Order:

The petitioner applied to the post of Anganwadi Teacher in Vellatore-1 pursuant to the notification issued calling for the applications in the year 2006. She states that she studied B.Com Computers at Kodad as a regular candidate and since there were no other eligible candidates she was appointed as Anganwadi Teacher in Vellatore-1 on 12.02.2007. Thus, she has been working in Vellatore-1 for the last 10 years. Now, she came to know that there is a clear vacancy in Ramireddypalem Anganwadi Centre which was her original native place and she constructed a house under Indiramma Housing Programme. Her husband is also native of that village. In view of the said circumstances, she sought for transfer from Vellatore to Ramireddypalem. She also states that the fifth respondent recommended her case to the fourth respondent along with two others on 13.09.2017 and, when the fourth respondent was not taking any action, the present Writ Petition is filed.

Learned counsel for the petitioner submits that the petitioner submitted a representation on 25.09.2017 stating that she is the permanent resident of Ramireddypalem of Kodad Town and also stating that her husband was suffering from renal problem. He has to undergo dialysis twice a week and he was also working as data entry operator in ICDS Project at Kodad as an outsourcing employee. In the absence of any rule for transferring the Anganwadi Teacher from one place to another place, this Court cannot issue any Writ of Mandamus as sought for by the petitioner. However, this will not prevent the fourth respondent from considering the case of the petitioner pursuant to the recommendation made by the fifth respondent.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
