HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION Nos.45559, 45618 and 45648 of 2018 COMMON ORDER:

1) Since the issue involved in the three writ petitions is one and the same, the writ petitions are disposed of by this common order. 2) Heard both sides.

3) These writ petitions came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.2 to 5 in taking steps to lay road in the plots situated at Kalyandurgam road in Survey Nos.51/ 4 and 51/ 5 admeasuring Acs.0.4.91 cents, 0.04.82 cents and 0.10 cents, respectively, in Papampeta village, Narayanapuram panchayat, Anantapuramu town, Anantapuramu District, without issuing any notice, without paying any compensation and without following due process of law, as illegal and arbitrary. 4) At the time when the matter is taken up for hearing, learned counsel for the respondents would submit that any action to be taken by the authorities shall only be in accordance with law.

5) Having regard to the above, the writ petitions are disposed of directing the respondents to follow due procedure established under the various provisions of law, including the provisions of Land Acquisition Act, in case they intend to lay road through the land of the petitioners situated in Survey Nos.51/ 4 and 51/ 5 admeasuring Acs.0.4.91 cents, 0.04.82 cents and 0.10 cents, respectively, in Papampeta village, Narayanapuram panchayat, Anantapuramu town, Anantapuramu District. No costs.

6) Consequently, miscellaneous petitions, if any, pending in these writ petitions shall stand closed.
