Heard Sri Mahadeva Kanthrigala, learned counsel for the petitioner.

Challenging the order dated 9.11.2017 in Crl. M.P. No.1844 of 2017 in C.C. No.57 of 2016 on the file of Special Judicial Magistrate of First Class, Madanapalle, Chittoor District, whereby and whereunder the application filed by the petitioner under Section 317 of Criminal Procedure Code, 1973 (for short, 'Cr.P.C.') was dismissed, the present Criminal Revision Case is filed. The order of dismissal of application herein neither can be construed as final order nor it can be construed as intermediate order, and therefore, the request in the present Criminal Revision Case cannot be acceded to, as the relief in the present Criminal Revision Case is to recall the warrant under Section 70 (2) of Cr.P.C. The Criminal Revision Case is accordingly dismissed as the Revision does not arise.
