HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO TRANSFER CIVIL MISCELLANEOUS PETITION No.791 of 2017 ORDER :

The transfer petition is filed by the petitioner/ wife under Section 24 C.P.C., to transfer F.C.O.P.No.975 of 2017 on the file of the Judge, Additional Family Court, Visakhapatnam, to the Senior Civil Judge, Peddapuram, East Godavari District. It is the submission that the matter is pending on reference to Lok Adalat at Visakhapatnam and if the matter is settled in Lok Adalat, the question of transfer does not arise. Having regard to the above, if the matter is not settled in Lok Adalat, the Lok Adalat Committee shall send back the matter to the Judge, Additional Family Court, Visakhapatnam, who in turn, with no loss of time, remit the matter to the Senior Civil Judge, Pitapuram, by virtue of this order,. Accordingly, the Tr.C.M.P. is partly allowed. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. There shall be no order as to costs.
