THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 45881 of 2018 ORDER:

Heard learned counsel for the petitioner and learned Standing Counsel for respondent Nos.2 and 3. With their consent, the writ petition is disposed of at the admission stage. Since this Court is not going into merits of the case, it may not be necessary to issue notice to the unofficial respondent. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of respondent Nos.2 and 3 in taking action against the illegal constructions made by the unofficial respondent in the land in Survey No.56/ 1/ EE, part situated at Muraharapally village, Shameerpet mandal, Medchal, Malkajgiri district, as illegal and arbitrary. Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to the respondent - authorities to consider the representation dated 26.10.2018, made by the petitioner bringing to the notice of the authorities the illegal constructions made by respondent No.6, by encroaching into the aforementioned property.

Having regard to the above, the writ petition is disposed of directing the respondent - authorities to deal with the representation dated 26.10.2018, made by the petitioner with regard to the illegal constructions made by respondent No.6 in respect of land in Survey No.56/ 1/ EE, part situated at

Muraharapally village, Shameerpet mandal, Medchal, Malkajgiri district, in accordance with law, after hearing the writ petitioner and respondent No.6, at the earliest. No order as to costs. Pending miscellaneous petitions shall stand closed in the light of this final order.
