CRL.P.MP.Nos.14175 & 14176 of 2017 This miscellaneous petition is filed under Section 320 of Cr.P.C seeking permission to compromise and compound the offences to quash the proceedings in Crime No.298 of 2017 on the file of Cyber Crime Police Station, Cyberabad, Ranga Reddy District, for the offences punishable under Sections 354-D, 384, 511 IPC & Section 67A ITA-2000-2008.
The petitioner/Accused and the second respondent/defacto complainant are present and they are identified by their respective counsels and produced Photostat copies of Aadhar cards to prove their identity.
The defacto complainant filed an affidavit explaining the reasons for lodging report with the police against the accused and the same is taken on file.
A joint memo of compromise is filed by both the parties, informing that the petitioner/Accused entered into compromise, explaining the reason for lodging the complaint against the accused by the defacto complainant. When terms of joint memo of compromise are explained in Telugu language, they are admitted to be true and correct. When enquired, the defacto complainant stated that due to misunderstanding, she lodged report with the police against the petitioner/accused at the instance of a practicing advocate and now they have settled all their disputes
MSM,J CrlP_12805_2017 amicably and compromised the matter, being colleagues in the office in Knoah Software Solutions Pvt. Ltd.
Further, it is now submitted that, both the petitioner/Accused and the second respondent/defacto complainant voluntarily entered into compromise due to intervention of elders and well-wishers and they wanted to lead peaceful life.
Therefore, I find that the compromise is voluntary in the interest of both parties and permission is granted to compound the offence. Hence, compromise is recorded in terms of the joint memo filed along with this petition. Accordingly, this petition is ordered. Crl.P.NO.12805 OF 2017 In view of the orders passed by this Court in CRL.P.MP.Nos.14175 & 14176 of 2017, this criminal petition is allowed.
Registry is directed to annex a copy of joint memo filed by both the parties, to this order.
Consequently, miscellaneous applications pending if any, shall also stand closed. No costs.
