THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE MS. JUSTI CE J. UMA DEVI WRI T PETI TI ON No.40747 of 2017 JUDGMENT: (Per Justice Sanjay Kumar) Challenge in this writ petition is to the e-auction sale notice dated 08.11.2017 issued by the Canara Bank, the respondent herein, proposing to put to sale the secured asset belonging to the petitioners on 11.12.2017.
By order dated 07.12.2017, this Court observed that no reasons were made out to stall the sale proposed to be held on 11.12.2017 but made the sale, if held, subject to further orders in this writ petition. While so, Sri Dishit Bhattacharjee, learned counsel for the respondent bank, would inform this Court that the sale proposed to be held on 11.12.2017 failed for want of bidders. In that view of the matter, as the challenge to the impugned sale notice dated 08.11.2017 has become purely academic, we see no grounds to adjudicate this writ petition on merits.
The writ petition is accordingly dismissed leaving all issues open. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
