This writ petition is filed seeking a Writ of Mandamus declaring the inaction of respondent in considering the case of the petitioner working as Anganwadi Helper of P.Byedigra village, Agali Mandal, Madakasira Taluk, Ananthapuram District for promoting to the post of Anganwadi Worker, P.Byedigra village, Agali Mandal, Madakasira Taluk, Ananthapuram District, as arbitrary, illegal and against Articles 14, 16 and 21 of the Constitution of India. Heard Sri Nagaraju Naguru, learned counsel for the petitioner and learned Government Pleader for Women Development and Child Welfare.

It has been contended by the petitioner that she was appointed as an Anganwadi Helper on 27.11.2015 for P.Byedigra village, Agali Mandal Madakasira Taluk, Ananthapuram District. Ever since her appointment, the petitioner has been discharging her duties to the best satisfaction of every one. The petitioner further submits that she is fully eligible and qualified to be promoted to the post of Anganwadi Worker. The grievance of the petitioner is that the post of Anganwadi Worker had fallen vacant consequent upon the retirement of the incumbent and the petitioner seeks consideration of her case for promotion to the post of Anganwadi Worker in the vacant post. The grievance of the petitioner is that though the petitioner is fully eligible and qualified to be promoted as Anganwadi Worker, respondents are not considering her case. Therefore, the petitioner contend that

appropriate orders be passed directing the respondents to consider the case of the petitioner for appointment as Anganwadi Worker. The learned Government Pleader appearing for respondents contend that the case of the petitioner will be considered along with other eligible candidates, in accordance with law. This Court, having considered the rival submissions of the parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation submitted by the petitioner on 26.11.2018 for promotion to the post of Anganwadi Worker in accordance with Rules and pass appropriate orders within four weeks from the date of receipt of a copy of this order.

With these observations, the writ petition is disposed of. No order as to costs.
